The Consumer Insurance Bill of Rights
If you have a claim against any insurance company, your own or someone else's, you have basic rights.
You have the right to:
- Choose who repairs your vehicle.
- Have your vehicle repaired to pre-loss condition at no additional cost out of your pocket.
- A lawyer if you are being sued.
- An independent appraiser or adjuster to assist you in negotiations.
- Loss of use if you were in an auto accident and it was not your fault.
- Complete restoration of value of your property, unless otherwise spelled out in an exclusion which you have signed.
- A written list of all denials of claim, including why your claim or part of your claim was denied.
- A lawyer to assist you in collecting all that is owed you on your claim.
- Demand a third party to mediate the difference you and the insurer feel your claim is worth.
- File a complaint, without reappraisals, with the Department of Justice.
